FDA extending comment period for Intentional Adulteration rule

The proposed rule on Intentional Adulteration will receive an extended comment period, stretching to June 30, 2014.

FDA is extending the comment period for the proposed rule on the Intentional Adulteration of food. Comments will be accepted until June 30, 2014.

The rule was originally published December 24, 2013, and is officially titled "Focused Mitigation Strategies to Protect Food Against Intentional Adulteration," and the associated Draft Qualitative Risk Assessment. FDA received request for an extended comment period and has granted a 90-day extension.

Under the proposed rule, a food facility would be required to have a written food defense plan that addresses significant vulnerabilities in its food production process. Facilities then would need to identify and implement strategies to address these vulnerabilities, establish monitoring procedures and corrective actions, verify that the system is working, ensure that personnel assigned to the vulnerable areas receive appropriate training, and maintain certain records.

The proposed rule does not apply to farms and food for animals. Also in the proposed rule, the FDA describes its current thinking on this topic and solicits comment on other issues, including economically motivated adulteration.

The decision to extend the comment period comes on the heels of three public meetings to discuss the proposed rule. The meetings were held between Feb. 20 and March 13. For more information on the Intentional Adulteration rule, click here.
